Having failed to get Congress to pass his cap and trade bill-a bill better known as "cap and tax" because it would cause a dramatic increase in the cost of energy for American consumers-Barack Obama is now using the Environmental Protection Agency to impose this energy tax by government order. The EPA has ruled that the American public is "endangered" by greenhouse gases-using the discredited global warming science as its reasoning-and therefore subject to regulation under the Clean Air Act. This means that, once the rules take effect a year or two from now, the EPA would enact regulations far more costly than even the cap and trade bill the House passed last year.
Under the Congressional Review Act, Congress has the power to overturn this ruling, but they must do it by early June. Alaska Senator Lisa Murkowski, the senior Republican on the Senate Energy Committee, is sponsoring the resolution of disapproval and plans to put it to a vote next Tuesday, May 25. It is a privileged resolution. This means it must be voted on and only needs 51 votes to pass, not the 60 votes often needed in the Senate. This will be a close vote and your call can make a difference

The EPA plan to regulate every aspect of our energy consumption was originally designed as a scare tactic for Congress-pass the cap and trade bill or we will do it for you. It hasn't worked and now the EPA threat is more than a scare tactic-it's the real thing. The result will be that every firm in America that "emits" a greenhouse gas-department stores, office buildings, apartment complexes, small manufacturers, hospitals-will have to have a government permit. Even the EPA admits this would create a bureaucratic nightmare-millions of permits per year-that would create massive backlogs and stifle business.
The crippled American auto industry would also suffer under this rule, as EPA would have the power to impose its own fuel standard on every American car.

Although the science behind the EPA power grab is flawed, the issue here is not one of science but who should make decisions affecting the lives of every American? The EPA ruling, once put into effect, will impose a massive regulatory regime on many aspects of daily life as well as a dramatic increase in the cost of utility and fuel bills over time, without one vote by Congress or the American people. Unelected and unaccountable bureaucrats, trial lawyers and activist judges will be making the decisions.
